For the District Attorney (D. A)to file sexual assault charges there does not have to be signs of a struggle or physical evidence that an assault was made. Because of the seriousness of a sex crime it is only required that the crime be reported for the D. A to investigate the case. Intercourse with a person who is incapacitated by way of drugs, intoxication, or diminished mental capacity also qualifies as rape
